Privacy Notice for Texas Residents

This Privacy Notice for Texas Residents supplements the information contained in the Privacy Statement of Morris.com and its subsidiaries (collectively, “we,” “us,” or “our”) and applies solely to visitors, users and other who reside in the State of Texas (“consumers” or “you”). To reach that goal, we want you to understand how we handle your data. Our Privacy Policy is designed to inform you of how we may collect, use, disclose, and store information about you when you visit our websites, whether accessed through a computer, tablet, smartphone, or other devise, mobile sites, mobile applications and other applications. Also, this policy also contains the rights and choices available to you under the Texas Data Privacy and Security Act of 2024 (TDPSA).

Please read this privacy policy carefully to understand our policies and practices regarding your information and how we will treat it. By accessing or using this site, you agree to this privacy policy. This privacy policy may change from time to time. Your continued use of this website after we make changes is deemed to be acceptance of those changes. Check the policy periodically for updates.

Information We Collect

We collect aggregate and user-specific information on which pages consumers access or visit. This information is used to generate reports that help us access the value of an interest in the various sites and services we provide. We use the information we collect to improve the content of our sites and services. We can build better sites and provide better services if we know which pages our users are visiting, how often they visit and how long they stay on a page. The following provides examples of the type of information we collect from you and how we use that information.

Demographic Information We collect personal information, such as age or location We have a legitimate interest in understanding our users and providing tailored services.
Employment If you apply for a job posting, or become an employee, we collect information necessary to process your application or to retain you as an employee. This may include among other things, your Social Security Number. Providing this information is required for employment. We are required by law to collect information about our employees. We also have a legitimate interest in using your information to have efficient staffing and work force operations.
Feedback/Support If you provide us feedback or contact us for support we will collect your name and email address, as well as any other content that you send to us, in order to reply We have a legitimate interest in receiving, and acting upon, your feedback or issues.
Mailing List When you sign up for one of mailing lists we collect your email address or postal address. We have a legitimate interest in sharing information about our products or services.
Partner Promotion We collect information that you provide as part of a co-branded promotion with another company. We have a legitimate interest in fulfilling our promotions.
Subscription Purchase We collect your name, billing address, shipping address, email address, phone number and credit card number when you purchase a subscription. We use your information to perform our contract to provide you with products or services.
Surveys When you participate in a survey, we collect information that you provide through the survey. If the survey is provided by a third party’s privacy policy applies to the collection, use, and disclosure of your information. We have a legitimate interest in understanding your opinions, and collecting information relevant to our organization
Sweepstakes or contests When you participate in a sweepstakes or contest, we collect information about you, which includes contact information to notify you if you are selected. We have a legitimate interest in operating the sweepstakes. In some contexts, we are also required by law to collect information about those that enter into our sweepstakes, and we have a legitimate interest in complying with those laws.
     

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided. For example, if you provide us with personal information in order for us to prepare a 1099-MISC for independent contractors or monies award in a contest, we will use that information to prepare the 1099-MSC and submit it to the applicable taxing authorities.
  • To provide you with information, products or services that you request from us.
  • To provide you with email alerts, event registrations and other notices concerning our products or services, or events or news, that may be of interest to you.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.
  • To improve our website and present its contents to you.
  • For testing, research, analysis and product development.
  • As necessary or appropriate to protect the rights, property or safety of us, our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order or governmental regulations.
  • As described to you when collecting your personal information or otherwise set forth in the TDPSA.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information

In addition to the specific situations discussed elsewhere in this policy, we disclose information in the following situations:

  • Affiliates and Acquisitions – We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires our company, business, or our assets, we will also share information with that company, including at the negotiation state.
  • Other Disclosure with Your Consent – We may ask if you would like to share your information with other unaffiliated third parties who are not described elsewhere in this policy.
  • Other Disclosure without Your Consent – We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to company with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third party intermediary.
  • Public – Some of our sites may provide the opportunity to post comments, letters to the editor, or reviews, in a public forum or blog. If you decide to submit information on these pages, that information may be publicly available.
  • Partner Promotion – We may offer contests, sweepstakes or other promotions with third party partners. If you decide to enter a contest or sweepstakes, or promotion that is sponsored by a third party partner, the information that you provide will be shared with us and with them. Their use of your information is not governed by this privacy policy.
  • Service Providers – We share your information with service providers. Among other things service providers help us to process payments, and assist in the fulfillment of orders, e-mail distribution, list processing and analytics or promotions management.
  • Social Media Platforms – Account registration can be done by linking your Facebook or Google accounts. If you choose to link your social-media account or account relating to other third-party services, you may be asking third parties to send us certain information from those social media accounts or services accounts, and you are authorizing us to collect, store, and use what they send us in accordance with this Privacy Policy.

Sale of Personal Information

We will not sell your personal information to third party vendors.

Your Choices

You can make the following choices regarding your personal information:

  • Promotional Emails – You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that your receive. If you decide not to receive promotional emails, we may still send you service related communications.
  • Promotional Mailings – If at any time you do not want to receive offers and/or circulars from us you can remove yourself from our mailing lists by email us (our contact information is below) with “NO SNAIL MAIL” in the subject line along with your name, address and zip code. Please note that our mailings are prepared in advance of their being sent. Although we will remove your name from our mailing list after receiving your request, you will receive mailings from us that have been initiated prior to your being removed.
  • Promotional Text Messages – If you receive, a text message from us that contains promotional information you can opt-out of receiving future text message by replying “STOP.”
  • Access To Your Personal Information – If required by law, upon request, we will grant you reasonable access to the personal information that we have about you. You may request access to your personal information by contacting us at the address described below.
  • Change to Your Personal Information – We rely on you to update and correct your personal information. Most of our sites allow you to modify or delete your account profile. Note that we may keep historical information in our backup files as permitted by law. If our site does not permit you to update or correct certain information, contact us at the address described below.
  • Deletion of Your Personal Information – Typically retain your personal information for the period necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law. You may, however, request information about how long we keep a specific type of information, or request that we delete your personal information by contacting us at the address described below. In addition, we may keep your personal information as needed to comply with our legal obligations, resolve disputes, and/or enforce any of our agreements.
  • Objection to Processing or Revocation of Consent – In certain circumstances, you may object to processing of your personal information. If you revoke your consent for the processing of personal information then we may no longer be able to provide you services. In some cases, we may limit or deny your request to revoke consent if the law permits or requires us to do so, or if we are unable to adequately verify your identity. You may revoke consent to processing (where such processing is based upon consent) by contacting us at the address described below.
  • Online Tracking – Some browsers or other tools include “Do Not Track” (DNT) features which, when turned on, send a signal to websites you visit indicating that you do not wish to be tracked across websites over time. The Worldwide Web Consortium (W3C) has been working with industry groups and regulators to develop a DNT browser technology standard to provide a common understanding as to how to interpret the DNT signals, but to date no standard have been adopted. Since there is no standard at this time, we do not currently respond to DNT signals. We will follow the progress of the W3C in developing the standard. If and when a final standard is established and accepted, we will reassess how to respond to these signals.

How We Protect Personal Information

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information.

Some of our sites permit you to create an account. When you do, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

Third Party Applications/Websites

Our site contains numerous links to third parties. We have no control over the privacy practices of websites or applications that we do not own. You should refer to each of those third party websites to obtain information on their privacy practices.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you or a person registered with the Texas Attorney General that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of a minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or any authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request to access, delete or correct personal information within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

We will respond to a verifiable consumer request to opt out of selling or sharing personal information and to limit the use of personal information within 15 business days of receipt.

We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made the decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your TDPSA rights. Unless permitted by the TDPSA, we will not:

  • Deny you goods and services.
  • Charge you different prices or rates for good or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
